Terms and Conditions for the Licensing of Images

General

All payments made are for licensing the use of photographs for use under specified conditions and NO TRANSFER OF COPYRIGHT is implied. The copyright of all photographs is owned by, and remains with, Jim Shead.

This agreement represents the entirety of the terms and conditions between Jim Shead and his clients (the Client). No variation of these terms or conditions shall apply unless agreed in writing by both parties.

Any unauthorised reproduction of my copyright images constitutes an infringement of rights, rendering those responsible liable for the payment of fees not less than three times that charged for properly authorised reproduction, in addition to damages, if appropriate.

On full payment of the appropriate conditions of use, reproduction rights are granted to the Client, as specified on the invoice, and are not transferable.

The Client must credit all images as follows (unless indicated otherwise): "Photo by Jim Shead" or on websites by a visible text link to ""www.jim-shead.com". The cropping or manipulation of images is not allowed without express permission, and any such alterations to the presentation of an image must be acknowledged alongside the image, as agreed in writing by Jim Shead. Images must not be reproduced without the correct credit line. Clients who omit to do so will be charged additional fees, which will not be less than twice the original reproduction fee.

The Client indemnifies the Jim Shead against damages as a result of unauthorised or defamatory use of the pictures.

In the event of the Client's insolvency, bankruptcy or death no transfer of ownership in rights or materials from Jim Shead shall be deemed to have occurred other than those properly licensed by Jim Shead. Materials produced by the Client containing images from Jim Shead shall be considered to be infringing copyright unless rights have been fully paid for and licensed by Jim Shead. Therefore such products may not be used to settle the Client's outstanding liabilities without first settling any outstanding invoices due to Jim Shead from the Client.

Individual Use

In addition to the General terms and conditions listed above the following terms and conditions apply to photos licenced under this category:-

1. This licence is only available to individuals for use on non-commercial websites or publications. These include, but are not restricted to, personal publication of books, magazines, circulars, newsletters and similar printed matter where circulation does not exceed one thousand copies, personal websites, displays at lectures, use in non-commercial video, DVD or film.
2. A license only applies to one of the above uses. Where an image is to be used on more than one medium or document then each use must be licenced separately.
3. The images must be copied from the website and will not be sent to the client by any other means. If images are required to be delivered in some other way a separate licence category applies.
4. The licence for the use of an image on a website is for a five-year period.

In addition to the General terms and conditions listed above the following terms and conditions apply to photos licenced under this category:-

1. This licence is only available to individuals, companies, partnerships, charities and any other type of corporate body for use on their websites or publications where they are to be used for communication purposes and is not part of a Book or any other product that is to be sold. These include, but are not restricted to, the publication of books, magazines, circulars, newsletters and similar printed matter, use on a website, displays at lectures, use in a video, DVD or film that is not to sold .
2. A license only applies to one of the above uses. Where an image is to be used on more than one medium or document then each use must be licenced separately.
3. The images must be copied from the website and will not be sent to the client by any other means. If images are required to be delivered in some other way a separate licence category applies.
4. The licence for the use of an image on a website is for a five-year period.
5. If images are required to be incorporated into and product, book, magazine, DVD, video, film or any other item that is sold then a larger image must be licenced

In addition to the General terms and conditions listed above the following terms and conditions apply to photos licenced under this category:-

1. This licence is available to individuals, companies, partnerships, charities and any other type of corporate body for use on their websites or publications. These include, but are not restricted to, the publication of books, magazines, circulars, newsletters and similar printed matter, use on a website, displays at lectures, use in video, DVD or film.
2. A license only applies to one of the above uses. Where an image is to be used on more than one medium or document then each use must be licenced separately.
3. The images will normally be sent to the client as attachments to emails but if images are required to be delivered in some other way a separate charge may apply.
4. The licence for the use of an image on a website is for a the life of the website and is not transferable to any other website.
